Shipping
1) Shipments will be send after payment and normally within three working days.
2) Seeds are packaged in sealed bags with bubble-wrap to avoid damage in the post.
3) Customers outside the EU please check on any import restrictions on chili pepper seeds before making a purchase. Pepperseeds.eu can’t be held responsible for any damage to seeds or seeds being destroyed by customs.

1. General
1.1 These general conditions apply to all offers of Pepperseeds.eu. The conditions are accessible to everyone and included on the website of Pepperseeds.eu. On request we will send you a written copy.
1.2 By placing an order you agree with the delivery and payment conditions. Pepperseeds.eu reserves the right to change its terms and / or payment terms.
1.3 Unless otherwise agreed, the general or specific conditions or stipulations of third parties are not recognized by Pepperseeds.eu.
1.4 Pepperseeds.eu guarantees that the delivered products comply with the agreement and meets the specifications stated in the offer.
2. Delivery
2.1 Delivery takes place while supplies last.
2.2 In the context of the rules of distance purchasing orders will be delivered by Pepperseeds.eu within at least 30 days. If this is not possible (because the ordered products are out of stock or no longer available), or delayed due to other reasons, or an order cannot or only partially executed, consumers will receive a notice within one month after placing the order message and in that case he has the right to cancel the order without costs or penalty.

3. Prices
3.1 Prices within the duration of the offer will not be increased unless legal measures are necessary or if the supplier temporary increases his prices.
3.2 All prices on this site are subject to misprints. For the impact of misprints no liability is accepted.
3.3 All prices on the site are in Euros and include VAT.
4. Term of approval / revocation law
4.1 If there is a consumer purchase, under the Act on Distance sales (Article 7:5 BW), the buyer has the right to return (part of) the goods within a period of 7 days without giving a reason. This period begins when the ordered goods are delivered. If the buyer has not returned the goods after this period to Pepperseeds.eu, the purchase is a fact. The customer is obliged, before proceeding to returning the goods within the period of 7 working days, to notify in writing to Pepperseeds.eu. The customer must prove that the delivered goods are returned on time, for example through proof of mail delivery. Return of the goods must be in original packaging (including accessories and documentation) and in new condition. If the goods are used, mortgaged or otherwise corrupted, the right to terminate the order becomes invalid. Subject to what is stipulated in the preceding sentence, Pepperseeds.eu will ensure that within 30 days after receiving of the products properly returned, the full purchase amount including the calculated shipping to the customer will be refunded. The return of the goods is the sole responsibility and risk of the customer. The costs being made for returning the goods are not refunded.
4.2 The right of rescission, as described in the preceding paragraph shall apply only to the goods and will in no way relate to services.
4.3 The right of withdrawal does not apply to:
- services to be implemented, with the consent of the consumer, begun before the period of seven days.
- Goods or services whose price depends on fluctuations in the financial market, on which the supplier has no control.
- Goods which are made according to the consumer's specifications, including customizations, or a which are clearly personalized
- Goods or services which can’t be returned due to their nature, for example due hygiene or that rapidly decay or expire.

7. Agreement
7.1 An agreement between a customer and Pepperseeds.eu is established after an order is assessed by Pepperseeds.eu on feasibility.
7.2 Pepperseeds.eu reserves the right, without giving any reason, not to accept orders or contracts or only to accept under the condition that the shipment takes place after COD or prepayment.
8. Images and specifications
8.1 All images, photographs, drawings and data, concerning weight, dimensions, colors, graphics and labels on the website of Pepperseeds.eu, are only approximate, are indicative and may not qualify for compensation or rescission of the contract.
9. Force Majeure
9.1 Pepperseeds.eu is not responsible, if and insofar as its commitments can’t be fulfilled due to force majeure.

Delay or failure by our suppliers, disruptions in the Internet, disruptions in the electricity failures in e-mail traffic and disturbances or changes in supplied by third parties technology, transport problems, strikes, government measures, supply delay, negligence by suppliers and / or manufacturers of Pepperseeds.eu as well as from individuals, staff sickness, defects in appliance or shipment tools count explicitly as force majeure.

10. Liability

11. Retention

14. Governing Law and Jurisdiction
14.1 All agreements are subject to Dutch law.
14.2 Disputes arising from an agreement between Pepperseeds.eu and buyer, which can’t be resolved by mutual agreement, will come to attention of the competent court within the district of Amsterdam, The Netherlands, unless Pepperseeds.eu prefers to give the case to the competent court of the domicile of the buyer, except issues and disputes belonging to the competence of the magistrate.
